1. Agreement to these terms

These Terms of Service (“Terms”) govern your use of ScalebyPin, its website and services. By using ScalebyPin, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. What the service does

ScalebyPin helps sellers promote their own products on Pinterest:

• You connect your own Etsy shop with read-only access and choose the listings you want to promote.
• We create drafts of Pinterest pins from your listing titles, descriptions and photos.
• You review each draft and approve, edit or reject it.
• Only pins you approve are published or scheduled to the Pinterest boards you choose, each linking back to its listing.

ScalebyPin never publishes a pin without your approval and never changes anything in your Etsy shop.

3. Your account

You must be at least 18 and able to enter into a binding agreement. You are responsible for keeping access to your account secure, for providing accurate information, and for all activity under your account. Tell us promptly if you believe your account has been used without permission.

4. Your shop and your content

You may connect only Etsy shops and Pinterest accounts that you own or are authorized to manage, and upload only photos, text and products that you have the rights to use. You keep all rights to your content.

You give ScalebyPin permission to store and process your content only as needed to provide the service to you, as described in the Privacy Policy. We do not use your content or Etsy data to train AI models.

5. Generated pins

Pins, images, titles and descriptions created for you belong to you, to the extent we hold any rights in them. They are created with the help of AI and may contain mistakes. You are responsible for reviewing each pin before you approve it, including that it accurately describes your product.

6. Free pin

We may offer one free pin, made from a photo you upload or a listing of your own connected Etsy shop. It is limited to one per person; we limit it per account and may also use email address, IP address or device. We may change or end the free pin at any time.

7. Subscriptions and payments

The price, billing period and renewal terms of a paid plan are shown before you pay. Payments are processed by Lemon Squeezy, our reseller and merchant of record, which charges you, handles sales tax and VAT, and issues your receipts; we never see or store your card details.

A plan renews automatically until you cancel. You can cancel at any time in your account or by writing to us; cancellation takes effect at the end of the current billing period, and pins already published stay up. Fees are non-refundable except where required by law or stated at purchase.

8. Acceptable use

You agree not to:

• use ScalebyPin unlawfully or to infringe anyone’s rights;
• connect or promote shops, listings or content that you are not authorized to use;
• use pins to mislead buyers, or in ways that break the rules of Pinterest, Etsy or another connected service;
• interfere with the service, bypass its limits or security, or access it by automated means we have not provided.

9. Third-party services

ScalebyPin works with services such as Etsy, Pinterest and Lemon Squeezy, which have their own terms and policies. You are responsible for following them. These services may change or limit their integrations, and we are not responsible for them.

The term “Etsy” is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

10. No guaranteed results

Pinterest decides how pins are shown. We do not guarantee any number of views, visits, orders or sales. Examples and numbers on our website are illustrations, not promises.

11. Availability and disclaimers

We may change, suspend or discontinue parts of ScalebyPin. To the extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind.

12. Suspension and termination

You may stop using ScalebyPin and delete your account at any time. We may suspend or end your access if you materially breach these Terms, put others at risk, or if required by law. Sections that by their nature should survive termination will survive.

13. Limitation of liability

To the extent permitted by law, ScalebyPin is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

14. Changes to these Terms

We may update these Terms. We will post the new version on this page, update the date above, and notify you by email of material changes. If you keep using ScalebyPin after that, you accept the updated Terms.
